This stuff that Trump is now doing to undermine our supposed democracy really frightens me. His Supreme Court is so complicit in helping him destroy our Country. We have to stop it now. But how and worse why does an old, infirm man want to steal more from a country whose current Congress supports that destruction and the bankruptcy of our country. He is not respected or even trusted by our allies. He is considered a clown. Wake up Republican Congress, He will destroy you along with us if we don't stop him.
When Trump was on "The Apprentice", he "fired" people - it was an act. In reality, Trump never fires people. He has other people do the dirty work so his hands stay clean. He has no respect for anyone, so he doesn't bother to give the people he wants gone the opportunity of a face-to-face rejection. I think the least America can do is the same - on November 3rd, a resounding "You're Fired" handed to him, and maybe help, in the form of the Capitol Hill Police escort, pushing him out of the WH.
Well said. In dismissing the arguments of his opponents, Scalia once said that original meaning was better than nothing (especially when the text did not give him what he wanted). In his book, Worse Than Nothing, Erwin Chemerinsky makes the case that Constitutional jurisprudence can and should evolve along with evolving notions of justice. The current court has pretty much dispensed with the notion of State Decisis. The unitary executive theory fails even the originalism test.

Thank you for this thoughtful piece about the unitary executive theory and the irony of its recent creation by the Reagan White House lawyers.
